Terms of Service

1. The agreement
These terms govern your use of NovaCube, which is operated by NovaDyne Sdn Bhd (“NovaDyne”, “we”), a company incorporated in Malaysia, of B-01-19, EMHUB, Persiaran Surian, Seksyen 3, Taman Sains Selangor, Kota Damansara, Petaling Jaya, Selangor, Malaysia. By creating an account or using the service you accept these terms. If you are accepting on behalf of a company, you confirm you are authorised to bind that company.
2. Your account
You are responsible for the accounts you create, for keeping credentials secure, and for what your users do with the service. Tell us promptly if you believe an account has been compromised.
3. Your data is yours
You keep all rights to the data you put into NovaCube. We use it only to run the service for you — including sending the necessary content to AI providers so the assistant can do its job. We do not sell it. You may export your data at any time, and you may ask us to delete it when you leave.
4. Acceptable use
You may not use NovaCube to:
- send unsolicited bulk messages, or message people who have not agreed to hear from you;
- break the law, or infringe anyone’s rights;
- attempt to access another customer’s data, or probe or disrupt the service;
- misrepresent an AI reply as coming from a named human where that would deceive someone.
Messaging over WhatsApp and Telegram is additionally subject to Meta’s and Telegram’s own policies. Breaching those can get your messaging access suspended by them, not just by us.
5. Fees and AI credits
Subscription fees are billed in advance for the plan you choose. AI features (assistant replies, transcription, image and video generation) consume prepaid credits, charged as you use them. Credits are non-refundable once consumed. We will tell you before we change prices.
6. Availability
We work to keep NovaCube available and take regular, verified, off-site backups. We do not promise uninterrupted service, and we may take the service down for maintenance. Where we have agreed a specific service level in writing, that agreement governs.
7. The AI is an assistant, not an adviser
AI-generated replies, summaries and drafts can be wrong. You are responsible for reviewing anything that matters before you rely on it or send it to a customer. NovaCube is not a substitute for legal, financial, tax or professional advice.
8. Suspension and termination
You may cancel at any time. We may suspend or terminate an account that breaches these terms or that puts the service or other customers at risk. On termination you can export your data; after 90 days we delete it, subject to any legal retention we are required to observe.
9. Liability
To the extent the law allows, our total liability arising out of the service is limited to the fees you paid in the 12 months before the claim, and we are not liable for indirect or consequential loss, including lost profits or lost data where you had the ability to export it. Nothing here limits liability that cannot lawfully be limited.
10. Governing law
These terms are governed by the laws of Malaysia, and the courts of Malaysia have exclusive jurisdiction over any dispute arising out of them.
